🛡️ Munich Regional Court I: Judicial confirmation of the service
We initiated proceedings before the Munich I Regional Court after a credit institution blocked payments from customers to selbstauskunft.de in online banking.
As part of the legal proceedings, the court found that selbstauskunft.de provides a genuine, valuable service and executes customer orders properly. This explicitly confirmed the legal classification of our service.
We consistently pursue comparable cases in court in order to protect the interests of our customers and the proper performance of our services.
Transparency through overperformance: The ruling of the Regional Court of Düsseldorf
In the interests of maximum legal certainty, we have accepted a layout optimization by way of a declaratory judgment, as we share the assessments of consumer protection associations and always strive for maximum transparency.
While our practice of displaying the price at the top of the form has always been confirmed as legally compliant under civil law (as the customer is informed before entering their data), competition law required that the price be displayed directly on the order button. We have decided to retain the proven price indication at the top and, since this ruling, have been displaying the price directly on the button as an additional confirmation ("double-check principle").
Nationwide civil law recognition
Some civil law titles are issued in the form of default judgments. This is particularly due to the fact that in the Schufa environment, court mail is often ignored by recipients. Important for legal assessment: Even in the case of a default judgment, the court conducts a conclusiveness review in accordance with § 331 ZPO (German Code of Civil Procedure). A judge will only issue such a judgment if the facts described justify the claim asserted. If the contractual basis or pricing were legally contestable, the court would not be allowed to uphold the claim despite the absence of the opposing party.
⚖️ Consistent enforcement of claims
Based on the established case law mentioned above, selbstauskunft.de relies on the civil law validity of concluded service contracts. For this reason, we consistently pursue outstanding service fees through legal action if customers fail to meet their payment obligations without good reason.
This is done to protect the more than 1,000,000 honest customers who value our service. Anyone who refuses to pay will also bear the costs of dunning, lawyers, and court costs in the event of a conviction.
